The Commerce Department has recently announced that it will issue AD orders on polyethylene retail carrier bags that originate from Indonesia and Taiwan. This is based upon the final injury determination issued by the International Trade Commission (ITC) which concluded that there is a threat of material injury as a result of the dumping of these carrier bags.
Up to now, Customs has suspended liquidation of entries of carrier bags from Indonesia and Taiwan that were entered on or after April 30, 2010, which is the publication date of the ITC final injury determination.
Customs is to refund cash deposits already made or cancel any bonds posted for carrier bags imported from Indonesia for the period of November 3, 2009 through April 29, 2010 and for carrier bags from Taiwan, October 27, 2009 through April 29, 2010. With regard to entries of carrier bags from Indonesia and Taiwan that were entered on or after April 30, 2010, suspension of liquidation will continue. For entries made on or after April 30, 2010, Customs will collect cash deposits for all importation of carrier bags from Indonesia and Taiwan. The current “all other” rate for carrier bags from Indonesia is 69.64%, and from Taiwan, it is 36.54%.
