Beginning February 20, 2011,  prospective employers will need to complete part 6 of Form I-129.   Part 6 of the new Form I-129 includes a certification regarding the release of controlled technology or technical data to foreign persons in the United States. Specifically, Part 6 obligates an employer to certify that they have reviewed the Export Administration Regulations ("EAR") and the International Traffic in Arms Regulations ("ITAR") and determined that either: (1) a license is not required; or (2) a license is required and the employer will prevent the foreign national's access to controlled technology until and unless they receive the requisite license.   Our webinar is designed to review and assist you in understanding:
