The Obama Administration has issued a notice to all federal agencies directing that:
- No proposed or final regulation be sent to the Office of the Federal Register (the "OFR") for publication unless and until it has been reviewed and approved by his administration,
- Proposed or final regulations that are already at the OFR that have not been published are to be withdrawn, pending review, and
- Consider extending for 60 days the effective date of regulations that have been published in the Federal Register but not yet taken effect, for the purpose of reviewing questions of law and policy raised by those regulations.
An exception is provided for emergency situations or other urgent circumstances relating to health, safety, environmental, financial, or national security matters.
Customs and Border Protection has not yet indicated whether it will push out the effective date of it’s “10+2” Importer Security Filing program for marine cargo, currently scheduled for implementation on January 26, 2009. (See our recent newsletter for more information on this program.)
