No Fake News Here …. It’s Official List 3 Section 301 Rates to Increase May 10

The official notification of List 3 (aka the supplemental $200 billion trade action) rate increase is set to be published in the Federal Register on May 9, 2019. The increase from 10% to 25% is expected to take effect at 12:01am May 10, 2019. Customs will amend the Rates of Duty-1 general column heading of 9903.88.03 by replacing 10% with 25%; U.S. Note 20(e) and 20(g) will also be amended to delete 10% and inserting 25%.

The rate increase is planned even though the Chinese delegation plans to meet to hammer out a trade deal that is acceptable to both countries.

Will there be an exclusion process for List 3? The USTR has stated there will be an exclusion process – but no time table has been announced.

Will there be a List 4? If there is a List 4, it would include the remaining HTS numbers – footwear, apparel, and consumer electronics. The U.S. consumer’s pocketbook would be “hit” with tariffs on these items. It is unknown if the Trump administration would follow through on this threat. If so, there would be a public notice, comment period and hearings.
